I have taken due notice of the Privacy Statement and have also been informed about my rights relating thereto (e.g. the possibility of revoking my approval of data handling).
Please take note:
The disclosure of your date of birth, gender, Austrian Register of Companies number, Central Association Register number as well as fax number (entering is not mandatory) entails acceptance that these statements may be stored and processed by the Austrian Patent Office for in-house purposes such as improved contacting and statistics. In cases where there is more than one applicant you should only disclose the foregoing data of said applicants subsequent to their express approval.
Also note that all data on the application form are subject to inspection of files as prescribed by law. Due to the online publications in the course of the Austrian Patent Office’s official publications the bibliographical data of those applying and representing are also published in the registers or official publications of the Austrian Patent Office, but also in EUIPO and WIPO databases, or can be found by third parties using Internet search engines.

II. EU sanctions

Applicant (Individual)
If the intention is to apply for the design in the name of several natural persons or legal entities, e.g. the shareholders of a stock company with limited responsibility a separate entry must be filled for each said person/legal entity (please click the button "+ Applicant" ("further applicant(s)")).
Applicant (Business/Company)
Please specify the complete and official company/association designation according to the company/association register (no abbreviations, please!) as well as the complete and valid address (no P.O. box, please!).

Representation
Whereas a representative is entitled to take legally binding action on behalf of the applicant in relation to the Office a correspondant, i.e. a natural person or legal entity residing or having a place of business in the home country, is merely authorized to receive mail items such as registered letters issued by government authority etc. (usually to an address differing from the applicant’s address) in place of the applicant.
When is the appointment of a representative and/or correspondant necessary?
* Provided the applicant resides or has a place of business in Austria or another country of the EEA (these are the EU member states, Iceland, Liechtenstein, Norway) or Switzerland the nomination of a representative or authorized recipient is not required but may be made voluntarily.
* The lack of a residence or a place of business on the part of the applicant in the aforementioned countries however necessitates the nomination of a representative who/which is either
- a person with an address in Austria, another EEA country or Switzerland (in this case a written authorization or the announcement of a subsequent submission of the same must be appended), or
- a person or corporation, i.e. an attorney at law, patent attorney, or notary (in this and only this case the appointment following upon the power of attorney suffices; appending or subsequently submitting said power of attorney is possible. The pertinent professional regulations of Austria apply to foreign professional representatives in regard to their power of representation).
Please note: it is not necessary to cite separately the names of persons such as managing directors, authorized signatories and proxies who according to the provisions of corporate law are authorized to represent.
Foreign professional representatives have to comply with the relevant national legislation in order to exercise the respective professional practice in Austria. Under these provisions, it is necessary to contact the concerned authority, either the Bar Association Vienna (Wiener Rechtsanwaltskammer) or the Austrian Patent Lawyers Association (Patentanwaltskammer) (office@rakwien.at (Lawyers) resp. office@oepak.at (Patent Attorneys)) BEFORE representing clients in Austria for the first time. Having received it please forward the concerned authority’s answer to the Austrian Patent Office. Patent attorneys are furthermore to be included in a separate registry according to paragraph 16a Patent Attorney Law.
Such representatives, who are temporarily active in Austria, are not to be included in the registry of the Austrian Patent Office.
Correspondents:
The Correspondent is a natural or legal person domiciled or domiciled in Austria who is authorized to receive postal items (RSb letters, etc.) for the applicant. If the domicile or branch of the applicant is located in the EEA or in Switzerland, the applicant may also appoint a Correspondent instead of a representative.
